The website www.ezkapade.com (“the site”) is published by SAS EOS REUNION, whose registered office is located at 8 RUELLE BOULOT 97400 SAINT DENIS REUNION FRANCE, registered with the Paris Trade and Companies Register under number 920369337, (hereinafter “SAS EOS REUNION” or “the Company”) and whose trade name is “EOS REUNION”.

The general terms and conditions of sale detailed below apply to all orders placed with the Company for all items and services offered on the website www.ezkapade.com. They are permanently available on the Site.

The Company reserves the right to adapt or modify these terms and conditions at any time, the version of the general terms and conditions of sale applicable to any transaction being that which appears online on the website www.ezkapade.com at the time of the order. Placing an order implies full and unreserved acceptance of these terms and conditions by the person placing the order (hereinafter “the Customer”).

1. Prevention

 The Website is exclusively reserved for persons over the age of 18.

 Alcohol abuse is dangerous for your health. Please drink responsibly.

​2. Validity of the offers

Offers are only available to consumers with a delivery address in countries where the Company provides delivery via a transport provider.

The products presented on the website are valid while stocks last. In the event of a debit or payment for an order for an unavailable item, the Company undertakes to reimburse the Customer within fifteen (15) days. The Company undertakes to notify the Customer who has placed an order for an unavailable item by email.

3. Products  

The products offered for sale are those described on the Website on the day the Customer visits the site. The Company takes the utmost care in presenting and describing these products in order to provide the Customer with the best possible information. However, it is possible that non-substantial errors may appear on the Website, which the Customer acknowledges and accepts.

 The photos representing our products are for illustrative purposes only. These photos, like the texts illustrating the products, are not contractually binding.

4. Prices

The prices shown on the Website are final. They are indicated in Euros (€) and governed by French law. They include all taxes (including VAT), except for Customers who have provided a delivery address outside the European Union, in which case prices are exclusive of tax.

They are guaranteed subject to typographical or printing errors.

 These prices do not include a flat-rate contribution to shipping and packaging costs, which remain the responsibility of the Customer, except in the case of a temporary or permanent promotional offer.

 In the case of export outside French territory, customs clearance and the payment of various duties and taxes are the sole responsibility of the Customer.

 Prices are subject to change at any time without notice. Items will be invoiced on the basis of the prices in force at the time the order is placed.

​5. Payment terms

 Products are payable in cash on the day of the actual order.

Products or services must be paid for in Euros (€). Any bank charges incurred by the payment, regardless of the terms, will be borne by the Customer.

The goods delivered remain the property of the Company until payment has been received.

An invoice will be sent to the email address provided when the order was placed. It will be issued in accordance with the price list in effect on the day the order was placed. The Company accepts no responsibility for any data entry errors.

​6. Accepting the offer

All orders imply express and irrevocable acceptance of the prices and descriptions of the products available for sale. Confirmation of the order by the Customer implies acceptance of the general terms and conditions of sale.

7. Delivery and Transport

Deliveries are made by a transport provider who transports the goods to the delivery address specified by the customer.

In some cases, products may be delivered in several separate shipments.

The Company processes paid orders and sends them to the transport provider via EDI messages.

The estimated delivery times are as follows: 3 business days (France), 5 business days (Belgium, Luxembourg, Spain), 7 business days (DROM), 10 business days (Other).

All these times are average times given for information purposes only. Exceeding these times (for example, in the event of exceptional closure or high activity) cannot under any circumstances be held against the Company, nor give rise to termination of the contract or any compensation for damages.

Transport risks are borne by the Customer from the moment the goods leave the warehouse. The Customer must check the condition of the packaging and the conformity of the items delivered and immediately report any anomalies to the Company. Any reservations must be noted on the delivery note presented by the carrier and must be sent within 48 hours by email to: contact@ezkapade.com.

8. Right of withdrawal

The Customer has a withdrawal period of fifteen (15) days from the delivery of the products to exercise the right to withdraw from their order.

In this case, the Customer must notify their wish to withdraw by email to contact@ezkapade.com, specifying their first and last name, address, telephone number, and order reference number.

 The Customer may use the withdrawal form below:

The products must then be returned in their original packaging, unopened and unused, to the Company’s address, accompanied by the printed notification email, within fifteen (15) days of notification. Return shipping costs shall be borne exclusively by the Customer, unless the Company has delivered a product that is damaged or different from the item ordered. Products returned incomplete, damaged, or opened cannot be refunded.

Refunds will be made as soon as possible and no later than fourteen (14) days after the Company receives the products returned by the Customer, by crediting the credit card used for the purchase, after checking that the item and its packaging are in good condition.​

​9. Obligations of the parties

If an order is accepted, the Company undertakes to sell and deliver to the Customer the products ordered by the latter in accordance with the terms and conditions specified above.

The Customer undertakes to provide the Company with an address to which the delivery can be made. The provision of personal information (name, address, telephone number, email address, etc.) collected for the purposes of concluding the sales contract is mandatory. This information is essential for processing and shipping orders and issuing invoices. Failure to provide this information will result in the order not being validated. In the event of an error in the provision of this information, the Company cannot be held responsible for the inability to deliver the product. In this case, the customer remains responsible for payment.

 In the event that an incomplete address is provided, resulting in the inability of the transport provider to deliver, the Customer shall pay the delivery costs corresponding to the reshipment of their order.

10. Personal data

The collection of the Customer’s personal data is necessary for the processing of the order. This information is strictly confidential and is intended for the Company’s use only.

In accordance with the French Data Protection Act of January 6, 1978, the Customer has the right to access, modify, rectify, and delete personal data concerning him/her. If the Customer wishes to exercise this right, they simply need to write to SAS EOS REUNION, 8 RUELLE BOULOT 97400 SAINT DENIS REUNION FRANCE, indicating their surname, first name, and address.

The Company reserves the right to collect data on the Customer through the use of cookies in order to improve the personalized service provided to the Internet user.

11. Liability

The Company shall not be held liable for any inconvenience or damage related to the use of the Internet, such as service interruptions, computer viruses, external intrusions, or more generally any cases deemed to be force majeure by the courts.

12. Miscellaneous provisions

The invalidity or unenforceability of any clause in these general terms and conditions of sale or special conditions shall not affect the application or validity of the other clauses in the general terms and conditions of sale. Such clause shall then be replaced by the closest possible provision.

Neither the Company nor the Customer shall be held liable in the event of non-performance of the contract as a result of force majeure, including, but not limited to, war, riot, insurrection, transport disruption, import problems, strikes, shortages, fire, earthquake, storm, or flood.

13. Applicable law and competent court

These general terms and conditions of sale are governed exclusively by French law.

The commercial courts of PARIS shall have sole jurisdiction in the event of any dispute or disagreement relating to them.
